Telangana State Planning Board Vice Chairman B Vinod Kumar has expressed concerns about the proposed Government of National Capital Territory of Delhi (Amendment) Bill, 2023. He is urging the Centre to reconsider the Bill and uphold the principles of democracy and the Constitution. According to Vinod Kumar, the Bill weakens the authority of the elected government in Delhi and goes against the Constitution.

Vinod Kumar highlighted that Article 1 of the Indian Constitution states that India is a Union of States and has a federal structure. The elected governments in the states have specific rights and responsibilities for effective governance. The National Capital Territory of Delhi has similar features to a state, as recognized by Article 239AA. Vinod Kumar argued that giving sweeping powers to the Lieutenant Governor (LG), who represents the Central government, threatens the democratic mandate of the elected government and undermines the country’s federal structure.

Vinod Kumar also referred to a Supreme Court verdict that affirmed the powers of the Delhi government over administrative services in Delhi. He believes that the proposed Bill seems to nullify this verdict, raising concerns about the government’s respect for the judiciary and the principle of checks and balances in a democracy.

Vinod Kumar warned that if the Bill is passed, it could set a dangerous precedent, allowing the Centre to interfere in the affairs of other states. This approach could erode states’ sovereignty and hinder their ability to make decisions that suit their unique requirements.
