The Supreme Court has stopped the use of the National Security Act (NSA) against a Samajwadi Party leader in Uttar Pradesh in a revenue dues matter. The court criticized the state for not thinking properly before taking action. The court said that it does not make sense to use NSA in this case and that it is why people think there is political motivation behind it. The court has ordered that the petitioner be released immediately. The petitioner was already granted bail in two separate FIRs, which police used to apply for NSA proceedings.

The Samajwadi Party leader had claimed that he was falsely implicated in two cases and detained indefinitely with mala fide intention. The petitioner’s lawyers argued that the state misused the law to take away his personal liberty. The petitioner challenged the detention order before the Allahabad High Court but the plea could not be heard due to delays caused by the authorities. The state passed two extension orders of detention during the pendency of the petition before the high court.
