Telangana High Court Orders HYDRA and Revenue Officials to Follow Legal Procedures

The Telangana High Court, under the single bench of Justice T Vinod Kumar, has instructed HYDRA and Revenue officials to follow due legal procedures before demolishing educational institutions owned by Palla Rajeshwar Reddy, who is the Jangaon MLA from the BRS party.

Rahul Reddy, the Special Government Pleader (SGP), presented records from 1954 and 1955 showing the water spread area of the Nadem Cheruvu, which covers 61 acres. The records indicated that the petitioner’s institutions are within the buffer zone of the lake.

Despite these facts, the petitioner objected when HYDRA authorities visited the institutions to take action. The SGP assured the court that if HYDRA intends to take any action against the petitioner, it will first issue a notice. Therefore, the petitioner should not worry about sudden demolitions and filing writ petitions in court.

During the hearing, the SGP also requested that the petitioner be restrained from constructing any new buildings in the buffer zone of Nadem Cheruvu. The judge agreed with this request, advising the petitioner not to proceed with any construction. The judge made it clear that if any permissions for construction were obtained fraudulently, the petitioner would face serious consequences for continuing with the construction.

Justice Kumar further advised the SGP to obtain maps of the lake from the Survey of India, Uppal, and the National Remote Sensing Agency, Sanathnagar and Shadnagar. These maps would provide a clear picture of the lake, its Full Tank Level (FTL), and the buffer zone, which would help resolve the issue.

The judge was addressing a writ petition filed by institutions owned by Palla Rajeshwar Reddy, including Gayatri Educational and Cultural Trust, Anurag University, and Neelima Institute of Medical Sciences. The petition sought directions to prevent HYDRA from demolishing structures on 17.21 acres of land in Korramula village, Ghatkesar mandal, Medchal-Malkajgiri district. The court has since disposed of the writ.
