Delhi High Court to consider arguments from ED, CBI against Kavitha today

The Delhi High Court will hear arguments from the Enforcement Directorate and Central Bureau of Investigation on Tuesday in the case of BRS MLC K Kavitha’s arrest in the Delhi Liquor Policy case. The court started the hearing on Monday with Kavitha seeking bail in cases filed by ED and CBI. Justice Swarna Kanth Sharma is presiding over the case. Kavitha’s advocate, Vikram Chaudhary, argued that her arrest was against the rules. He mentioned that the ED had promised the Supreme Court not to take adverse steps against Kavitha. A petition was also filed in the SC for clarification on investigating women under CRPC.

Chaudhary highlighted that the Additional Solicitor-General had previously assured that no summons would be issued until further investigation in the SC. However, Kavitha was arrested the same day as a sudden search at her house. The advocate emphasized Kavitha’s importance as a party leader and MLC and claimed that she was falsely charged. He also criticized the investigating agencies for changing notice sections from 161 to 41(A) without explanation, violating rights.

Additionally, Chaudhary informed the court that while Kavitha was in judicial custody, the CBI filed a petition for questioning without her knowledge. The ED and CBI have submitted counter-affidavits, and their version will be heard after noon on Tuesday. The court appreciated Chaudhary’s arguments and allowed the agencies to present their side separately.
