Delhi Government Prevails in Supreme Court Ruling on Controlling Bureaucracy in Delhi

The Supreme Court has made a ruling on who controls the bureaucracy in Delhi. They have decided that the Delhi administration should be in charge of providing services, with a few exceptions. The court disagreed with Justice Bhushan’s decision that the Delhi government has no control over services.

During the hearing, a five-judge Constitution Bench questioned the need for an elected government in Delhi. The conflict arose after the Centre claimed that they should administer Union Territories. In February 2019, a two-judge court panel issued a split decision on the authority of the Delhi government and the centre. This was then taken up by a three-judge bench, who submitted it to a constitution bench in May 2022.

The Supreme Court is still reading out their ruling, but it looks like they are in favour of the Delhi administration controlling bureaucracy in the National Capital.
