The Andhra Pradesh High Court has stated that in marital disputes, the convenience of the wife should be given more importance than that of the husband. This decision was made in response to a civil miscellaneous transfer petition filed by a woman seeking to transfer divorce proceedings initiated by her husband from Proddatur district court to Kadapa district court.
The woman had claimed that her husband filed for divorce after a domestic violence case was brought against him by her. She had since moved out of their shared home and into her uncle’s house, listing it as her place of residence in legal documents. The woman alleged that she faced harassment from her husband and in-laws every time she attended court hearings for the divorce case.
The High Court noted that the woman was not earning an income, while her husband was a software engineer with a monthly salary. Considering that there were other pending matrimonial cases between the same parties, the court decided it would be more convenient to transfer the divorce proceedings to Kadapa to avoid further inconvenience for both parties.
The Court dismissed the woman’s claim for reimbursement of traveling expenses and ordered the transfer of the divorce case to Kadapa district court.
