BRS MLC K Kavitha did not receive any relief from the Supreme Court on Tuesday in the Delhi Liquor Policy case. The reason for this is that the Enforcement Directorate (ED) had not yet filed its counter to her plea.
The Supreme Court has now postponed the hearing of the case to August 27. Kavitha’s bail plea was presented before a bench of Justices BR Gavai and KV Viswanathan. During the hearing, Additional Solicitor-General SV Raju, representing both the Central Bureau of Investigation (CBI) and the ED, informed the court that while the CBI had submitted its counter, the ED’s response was still pending. He requested the court for an additional week to submit the affidavit.
Kavitha had filed her bail petition in the Supreme Court on August 12 after the Delhi High Court rejected her bail request on July 1. The Supreme Court had earlier asked the investigating agencies to submit their counters to her plea.
Mukul Rohatgi, who represented Kavitha in court, argued that she was the only woman accused in this case. He pointed out that both Delhi Chief Minister Arvind Kejriwal and AAP leader Manish Sisodia, who were also involved in the case, had been granted bail. Rohatgi emphasized that as a woman, Kavitha had the right to bail under Section 45 of the Prevention of Money Laundering Act.
However, the Supreme Court declined to consider her interim bail request until it reviews the counters filed by both the CBI and ED.
