The US Citizenship and Immigration Services (USCIS) has clarified that nonimmigrant workers who are laid off from their jobs may have options to remain in the country for up to 60 days after their termination. During this time, they may apply for a change of nonimmigrant status, adjustment of status, or an employment authorization document. However, if they fail to take any action within the grace period, they and their dependents may have to leave the country within 60 days or when their authorized validity period ends, whichever is shorter. The USCIS also stated that individuals with B-1 or B-2 visas can search for employment and attend job interviews, but must ensure that their visa status is changed before starting any new role. They must obtain approval for a change of status from B-1 or B-2 to an employment-authorized status, or be admitted in an employment-authorized classification before beginning new employment.
